With stupid things like that and like "OMG MY CAT IS BEING BULLIED" I think you deserve a ban..
and what Nintendo said racist has to do with making fun of someone skin color religion ect.

Yep. Twilightnewmoonrover says she's Banned but she's still there!!! I can't take it how people are Banned and can still post!

She deserves a REAL ban...

Maybe it's a Bug, and when someone get's unbanned, their rank stays Banned?
