Damen3D Engine – Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the Damen3D Engine, the Damen3D Editor, and any related tools, components, documentation, or downloadable files (collectively referred to as the “Software”). By downloading, installing, or using the Software, you agree to be bound by these Terms.
If you do not agree with these Terms, do not use the Software.
1. License Grant
You are granted a non-exclusive, non-transferable, revocable license to download and use the Software for the purpose of creating, testing, and distributing projects made with Damen3D.
- You may use the Software for both personal and commercial projects.
- You may distribute the games or experiences you create using the Software, provided they do not violate any applicable laws.
You are not granted any rights to redistribute, resell, sublicense, or host the Software itself.
2. Intellectual Property
The Software, including but not limited to its code, design, architecture, artwork, documentation, and branding, is the exclusive property of Drake Hall (drakehall.co.uk) unless otherwise stated.
- You may not claim ownership of the Software.
- You may not remove or alter copyright notices.
- You may not reverse-engineer, decompile, or attempt to access the internal source code unless explicitly permitted.
Projects you create remain your property, including your assets, scripts, and designs.
3. Acceptable Use
You agree not to use the Software to:
- Violate any local or international laws.
- Create content that is illegal, harmful, abusive, or defamatory.
- Attempt to access or modify parts of the Software outside the intended use cases.
- Use exploits, hacks, or modification tools to interfere with normal functionality.
4. Updates and Changes
The Software may receive updates, improvements, or changes over time. These may include bug fixes, new features, performance enhancements, or licensing adjustments.
- Updates may be delivered automatically or manually.
- Continued use after an update constitutes acceptance of the updated Terms.
5. Privacy
The Software does not collect personal data unless explicitly stated. Anonymous analytics or crash reports may be used solely for product improvement.

6. Third-Party Content
The Software may include links, libraries, or optional integrations with third-party services or assets.
You acknowledge that:
- Third-party content is subject to its own terms and licenses.
- Damen3D is not responsible for issues caused by third-party components.
7. No Warranty
The Software is provided “as is” and without warranty of any kind. This includes, but is not limited to, implied warranties of:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
You use the Software at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law:
- Damen3D and Drake Hall shall not be liable for any damages arising from the use or inability to use the Software.
- This includes direct, indirect, incidental, special, consequential, or exemplary damages.
9. Termination
Your license to use the Software may be terminated if:
- You violate these Terms.
- You misuse or attempt to tamper with the Software.
Upon termination, you must stop using the Software and delete all copies in your possession.
10. Governing Law
These Terms are governed by and interpreted in accordance with the laws of the United Kingdom, regardless of conflict-of-law provisions.
